Terms and Conditions (AGB)
for the purchase of Afghan embroidery via the website guldusi.com
Scope
These General Terms and Conditions of Delivery and Payment govern the sale of Afghan embroidery by the Deutsch-Afghanische Initiative e.V. (hereinafter “DAI”) via the website guldusi.com to consumers (hereinafter referred to as “the Customer” in accordance with Section 13 of the German Civil Code (BGB)). The embroideries on offer are unique textile items, and their digital representation in the galleries may differ from the original in terms of colour and texture. As a Customer, please read the following Terms and Conditions of Delivery and Payment carefully before placing an order via guldusi.com. By placing an order via guldusi.com, you agree to the exclusive application of these Terms and Conditions of Delivery and Payment to your order. Any deviating terms and conditions of the Customer shall not be recognised.
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. In addition, the provider’s terms and conditions set out below apply. Any deviating or supplementary terms and conditions of the user shall not form part of the contract unless DAI expressly agrees to their validity.
In the event of any discrepancies, the German version of the Terms and Conditions shall prevail. English and French translations of the Terms and Conditions are provided for guidance.
Conclusion of the contract
The language available for the conclusion of the contract is German. We provide translated versions of the website in English and French, but cannot fully guarantee their completeness.
Your order via guldusi.com constitutes a binding offer to DAI to conclude a sales contract. The sales contract with DAI is concluded when the buyer submits the electronic order form by clicking the mouse, thereby making an offer to the seller to conclude a sales contract, which the seller accepts by dispatching the goods.
Order process
Browsing, virtual shopping basket
You are free to browse our range at your leisure. If you find something of interest, add the product to your virtual shopping basket. To do this, click on the “Add to basket” button in the product view. A “Shopping basket” icon will then appear in the top right-hand corner, which also shows the number of items you have selected. Click on the shopping basket to continue with the purchase process. You can, of course, remove products from your shopping basket at any time. To do this, click on the ‘Delete’ button (in the form of a bin icon) displayed next to the relevant product in the shopping basket list. Alternatively, you can set the quantity to zero.
Start the ordering process
Step 1: Your order
You start the ordering process by clicking the “Proceed to checkout” button in your shopping basket.
Step 2: Enter your address
You will now be asked to enter your address details. Both the billing address and delivery address must be completed in full. To continue, click “Review order”.
Step 3: Select payment method and confirm order
Here you will see an overview of all the products you have added to your basket, as well as any other costs associated with your order and the address and contact details you have provided.
Now enter your preferred payment method along with all the necessary details.
Correcting errors
Before submitting your order by clicking the “Place order” button, you have the option to correct your address details by clicking the “Back” button.
Step 4: Place order
By clicking the “Place order” button, your order is triggered and forwarded to us. You will receive an invoice at the email address you provided. By placing your order, you are making a binding declaration of your intention to purchase the goods. We will store the email, the address details you entered and the details of the products ordered. The invoice sent to you contains links to our Terms and Conditions and the Cancellation Policy. You can save or print these if required.
Price
The price of each embroidery item corresponds to the information on guldusi.com. All prices are final prices. This also applies to orders from abroad. The calculation is subject to differential taxation; the final price therefore does not include any chargeable VAT. Consequently, this is not shown on the invoice.
Delivery / Delivery time / Shipping costs
As soon as your order is received, we will check whether the embroidery is available. Your order will always be processed as soon as possible.
As the project manager travels frequently, there may be delays in communication, and the goods may take some time (up to a maximum of 4 weeks) to reach you. However, orders are usually processed within a few working days.
Delivery is only available within Europe and is at the customer’s expense and risk. Postage costs are based on the actual charges levied by Deutsche Post for letters, small parcels or standard parcels, which will be communicated to you during the checkout process. Packaging and packaging materials are included in these costs.
Retention of title
All goods delivered remain the property of DAI until full payment has been received.
Payment
The purchase price to be paid by the customer, plus any applicable shipping costs, is due immediately and without deduction and is settled during the online purchase process via the payment method selected by the customer. For payments, we will note the reference “GULDUSI”.
Right of withdrawal for consumers
Consumers are entitled to a statutory right of withdrawal in distance selling transactions as follows:
Cancellation policy
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the date of conclusion of the contract.
To exercise your right of withdrawal, you must inform us,

by means of a clear statement (e.g. a letter sent by post, fax or email) of your decision to withdraw from this contract.
To meet the withdrawal deadline, it is sufficient for you to send your notification of exercising the right of withdrawal before the withdrawal period expires.
Consequences of withdrawal: If you withdraw from this contract, we shall reimburse you for all payments we have received from you, including delivery costs (with the exception of any additional costs arising from your choice of a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days of the day on which we receive notification of your withdrawal from this contract. We will use the same means of payment for this refund as you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees in connection with this refund.
Special provisions regarding the right of withdrawal for digital content (Section 356(5) of the German Civil Code (BGB)):
Your right of withdrawal expires if
1. the trader has commenced performance of the contract after
2. the consumer has expressly agreed that the trader may commence performance of the contract before the expiry of the withdrawal period, and
3. the consumer has confirmed their awareness that, by giving their consent to the commencement of the performance of the contract, they lose their right of withdrawal.
Product changes
The online offering is continuously updated and expanded by the provider. Despite careful planning, changes to the content may be necessary in individual cases. The provider therefore reserves the right to make necessary adjustments to the content and methodology or deviations from the product description as stated on the website, provided that these do not significantly alter the subject matter and overall character of the online product in question.
Online dispute resolution
In accordance with EU Regulation No. 524/2013, the European Commission has established an online platform for the resolution of disputes (“ODR platform”) between traders and consumers. This can be accessed via the following link: http://ec.europa.eu/consumers/odr. The provider does not participate in dispute resolution proceedings before a consumer arbitration board.
Place of performance
The place of performance is the provider’s registered office.
Jurisdiction
If the user is a trader within the meaning of Section 14 of the German Civil Code (BGB), the place of jurisdiction for all disputes arising from contractual relationships between the user and the provider is the provider’s registered office.
Miscellaneous
The invalidity of individual provisions of the underlying contract, including these General Terms and Conditions of Delivery and Payment, shall not affect the validity of the remaining provisions.
